Enforcement
of Measure B's inadequate medical marijuana grow quantities of
6 mature flowering female plants has been stayed by Superior Court
Judge John Behnke, placing it on HOLD at the
present time in Mendocino County, through October 25, pending
the disposition of several relevent cases by the CA State Supreme
Court.
The
former Letter of Stipulation between Deputy County Counsel Zotter
and Laguna's attorney ED Lerman is no longer in effect but has
been replaced by the legally binding Stay from Judge Behnke.
Please
bear it in mind that some overzealous Deputies are likely to regard
the current situation as open season on patients, who do not currently
have ANY particular number of protected plants. If you have had

The
Mendocino Medical Marijuana Advisory Board has repeatedly been
promised a copy of the MCSO's written Medical Marijuana and Marijuana
enforcement instructions to Deputies, so that it is clear to all
concerned parties what procedures will be followed by Deputies
when investigating a marijuana garden. Several times we have been
informed that these instructions are in the process of revision
and will be provided when complete. We have never been provided
with said documentation during the present administration. During
the Craver administration, it was no problem. Stay tuned.
