The 25 MedMar plants per parcel Civil Nuisance Ordinance passed by the BoS and condified as MCC9.31 will shortly be litigated as an unconstitutional violation of equal protection as well as an impermissable modification of the State of California's Compassionate Use Act (Prop. 215).

The actual county code can be viewed online but the BoS draft version is easier to read and contains the same text. What is important to understand is that MCC9.31 is not an ordinance where Deputies are authorized to immediatley eradicate a medically qualified grower's plants. They first have to cite the grower and then begin an abatement procedure.

It is expected that the BoS will shortly attempt to criminalize MCC9.31 and add 'instant abatement' authorization for the MCSO. At present, they DO NOT have this.
